1. Overview

Nano Banana Pro ("Nano Banana Pro", "we", "our" or "us") provides creative AI tooling available at nanobananapro.photo and related domains. These Terms of Service are a legally binding agreement between you and Nano Banana Pro that governs your use of our website, desktop and mobile apps, APIs, and any beta or early-access features (collectively, the "Services"). By accessing or using the Services you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and Accounts

1. Minimum Requirements: You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into contracts. If you use the Services on behalf of an organization, you represent that you have authority to bind that entity.
2. Account Registration: When creating an account you must provide accurate, current, and complete information. You are responsible for updating your information as needed.
3. Security: You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately at support@nanobananapro.photo if you suspect unauthorized access.
4. Suspension: We may suspend or terminate your account if we suspect misuse, fraudulent activity, or violation of these Terms.

3. Subscriptions, Trials, and Billing

1. Plans: We offer free trials and paid subscription tiers as described on nanobananapro.photo/pricing. Each plan includes the features, usage limits, and support levels published at the time of purchase.
2. Billing: You authorize us and our payment processors to charge your selected payment method for all subscription fees, add-on credits, and applicable taxes. Charges recur automatically at the interval you select until you cancel.
3. Cancellations: You may cancel anytime through your account dashboard. Cancellation stops future billing at the end of the current term; fees already paid are handled under our Refund Policy.
4. Late Payments: If a charge fails, we may suspend access until payment is successful and you remain responsible for any outstanding amounts.

4. Acceptable Use

You will not (and will not allow others to):

• Reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the Services.
• Upload or distribute content that is unlawful, harmful, defamatory, infringing, or violates privacy rights.
• Use automated scripts or scraping tools that overload or disrupt our infrastructure.
• Misrepresent your affiliation with Nano Banana Pro or impersonate another person or entity.
• Use the Services to train competing foundation models without our written consent.

We reserve the right to investigate violations and cooperate with law-enforcement where required.

5. Intellectual Property and Feedback

All code, models, documentation, templates, visual assets, and other materials provided through the Services remain the exclusive property of Nano Banana Pro or its licensors and are protected by copyright and other intellectual property laws. You retain ownership of all assets, prompts, and outputs you lawfully upload or create, subject to the licenses granted below:

• By submitting content to the Services you grant us a non-exclusive, worldwide license to host, process, and display that content solely for the purpose of operating and improving the Services.
• If you voluntarily send feedback or suggestions, you grant us the right to use that input without restriction or obligation to you.

6. Confidentiality and Data Protection

We will handle personal data in accordance with our Privacy Policy and commercially reasonable security practices. You agree to keep confidential any non-public information or beta features we make available to you and to use such information only as permitted under these Terms.

7. Service Availability and Modifications

We strive to keep Nano Banana Pro online at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature or plan, including beta functionality, at any time with or without notice. If we discontinue a paid feature, we will provide a comparable alternative or a pro-rated refund.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Nano Banana Pro disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no guarantee that outputs generated by the Services will meet your requirements or that the Services will be error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Nano Banana Pro and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amounts you paid to us for the Services in the six (6) months preceding the event giving rise to the liability.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nano Banana Pro, its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of a third party.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be submitted to binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive or other equitable relief in court for infringement or misuse of intellectual property rights. You waive any right to a jury trial or to participate in a class action.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, legal requirements, or business priorities. If we make material changes we will provide notice via email or an in-product message. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of the updated agreement.
